Seller identity and merchant of record

Products shown on stellarwind.ai are created by Teo Bouancheau, trading as Stellarwind, hello@stellarwind.ai.

They are sold by Polar Software, Inc., 3500 South DuPont Highway, Dover, DE 19901, United States, which acts as merchant of record and authorised reseller. When you buy, your contract of sale is with Polar, under the Polar Checkout Buyer Terms (https://polar.sh/legal/checkout-buyer-terms). Stellarwind never invoices you or takes payment from you directly.

These terms set out the products and the licence Stellarwind grants. Nothing in them limits the rights you have under mandatory consumer law.

Products

Digital products (guides, ebooks and systems such as templates, workflows and related files) supplied as digital content without a tangible medium. The product page describes each product's content, format and essential characteristics before you buy.

Prices

Prices are shown on the product page and on the Polar checkout, in the currency displayed. As merchant of record, Polar calculates and collects the sales tax or VAT that applies to your purchase.

Order process

• Choose a product and open its Polar checkout.
• Enter your email address and payment details, and review the product and the total price.
• Confirm payment. Polar processes the payment and confirms the order.

Right of withdrawal

As a consumer, you normally have 14 days to withdraw from a contract concluded at a distance (French Consumer Code, art. L221-18).

For digital content not supplied on a tangible medium, this right does not apply once supply has begun before the end of that period, if all three of the following conditions are met (French Consumer Code, art. L221-28 13°):

• you gave your prior express consent for supply to begin before the end of the withdrawal period;
• you acknowledged that you thereby lose your right of withdrawal;
• you received confirmation of your agreement, as article L221-13 requires.

If any of these conditions is not met, you keep your right to withdraw for 14 days: tell Polar (support@polar.sh) or us (hello@stellarwind.ai), and the refund is issued by Polar.

Refunds

Stellarwind does not offer discretionary refunds. This does not affect your right of withdrawal where it applies, your legal guarantee of conformity, or refunds Polar grants under its Buyer Terms, applicable law and card network rules. Refunds are issued only by Polar.

Delivery and access

Once Polar has confirmed your payment, the product is made available through Polar as a signed, personal download link. Keep a copy of your files. If you cannot access a product you bought, write to hello@stellarwind.ai.

Licence granted

Each purchase grants you a personal, non-exclusive and non-transferable licence to use the product for yourself or within your own business. Ownership of the product stays with Stellarwind.

• You may not resell, sublicense, redistribute, publish or share the product or any substantial part of it.
• You may not include it in a product or service offered to third parties.
• Redistribution ends the licence, as set out in the terms of service.

Liability and warranties

You benefit from the legal guarantee of conformity for digital content: the product must conform to the contract, and defects existing at delivery that appear within two years of it are covered (French Consumer Code, art. L224-25-12 and following).

Products describe methods and systems; the results you obtain depend on your context and implementation, and no specific result is promised. Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited.

Personal data

Polar processes checkout and payment data under its privacy policy (https://polar.sh/legal/privacy). Stellarwind's processing of order information is described in the privacy policy (/privacy).

Applicable law and dispute resolution

These terms are governed by French law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live (Regulation (EC) No 593/2008, art. 6(2)). The sale itself is also governed by the Polar Checkout Buyer Terms.
